India's West Bengal state launched an appeal on Tuesday to overturn a life sentence in favour of the death penalty for a police volunteer convicted of the rape and murder of a junior doctor, a senior lawyer aware of the development said.

Roy was on January 18 convicted under charges which entailed a minimum sentence of life imprisonment, while the maximum could be capital punishment.

Sanjay Roy has been convicted of rape and murder of an RG Kar postgraduate trainee doctor by the Sealdah CBI court in Kolkata.

The West Bengal government is seeking the death penalty for Sanjay Roy in the RG Kar rape and murder case. Although a Kolkata court sentenced him to life imprisonment, they did not classify the case as 'rarest of rare.

A sessions court in Kolkata on Monday (January 20, 2025) sentenced Sanjay Roy, the convict in the rape and murder of a doctor at R.G. Kar Medical College and Hospital, to life imprisonment. Meanwhile, West Bengal CM Mamata Banerjee said that her government will plead for capital punishment for the convict in the Calcutta High Court.

Explaining the penalties of the section, the court said to the accused Sanjay Roy, 'I told you the previous day the charges you were convicted against and the charges that have been proven against you.

RG Kar rape and murder convict Sanjay Roy pleaded his innocence befor the court on the day of his sentencing on Monday. "I told you the previous day the charges you were convicted against and the charges that have been proven against you, " the judge told the accused Sanjay Roy, ANI reported.

Notably, the Central Bureau of Investigation (CBI) had pushed for death sentence for Roy. In the court Roy opposed death penality. "I am being framed, and have not committed any crime. I have not done anything and still, I have been held guilty," Roy told the court ahead of sentencing in the case," the convict said as reported by PTI.
